Terms of Service

These Terms of Service (the "Terms") are an agreement between you and ONYX ("ONYX", "we", "us") governing your use of https://onyx-crypto.com and the automated trading service available through it (the "Service").

By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.


1. Risk warning — read this first

Trading cryptocurrency futures with leverage can result in the loss of your entire deposit, and can result in losses very quickly.

  • Futures positions are liquidated by the exchange when losses approach your posted margin. Liquidation can happen within minutes, at any hour, without warning.
  • Leverage multiplies losses as well as gains. At 20x leverage, a 5% adverse price move can eliminate the margin backing a position.
  • Automation does not reduce market risk. An automated strategy applies its rules faithfully through conditions in which those rules lose money.
  • Past performance, live-verified statistics, and example results do not predict or guarantee future results.
  • You may lose more than you expected, and you may lose everything you allocate to a strategy.

Only use funds you can afford to lose entirely.


2. What ONYX is, and what it is not

ONYX is a tool. It runs automated trading strategies against your own exchange account, on your instruction, through an API key you provide.

ONYX is not:

  • not an investment adviser, broker, dealer, or portfolio manager. Nothing on the site or in the Service is investment, financial, legal, or tax advice, and nothing is a recommendation to buy, sell, or hold any asset or to follow any particular strategy;
  • not a custodian. We never hold, receive, or control your funds. Your assets remain in your own exchange account at all times;
  • not an exchange. Orders are executed by the third-party exchange you connect, subject to that exchange's own terms, fees, and availability;
  • not a guarantor of any outcome. We do not promise profits, minimum returns, uptime, or that any strategy will perform in any particular way.

Every trading decision you make, and every outcome that follows, is your own responsibility.


3. Eligibility

To use the Service you must:

  • be at least 18 years old and legally capable of entering into a binding contract;
  • not be located in, or a resident of, any jurisdiction where use of the Service or trading cryptocurrency derivatives is prohibited or restricted;
  • not be a person subject to economic or trade sanctions, and not act on behalf of any such person;
  • hold an account in your own name at a supported exchange, and comply with that exchange's terms and verification requirements.

You are responsible for determining whether your use of the Service is lawful where you live. We may restrict or refuse access to anyone, or in any territory, at any time.


4. Your account

You must give accurate registration information and keep it current. You are responsible for everything that happens under your account and for keeping your credentials confidential. Notify us immediately at contact@onyx-crypto.com if you suspect unauthorised access.

You may not share your account, transfer it, or let anyone else use it.


5. Connecting your exchange account

To use automated trading you must connect an exchange account by providing an API key.

You must provide a key with withdrawal permission disabled. We reject keys with withdrawal enabled. This protects you: such a key cannot move assets out of your exchange account.

By connecting a key, you authorise us to read your account information and to place, modify, and cancel orders in that account according to the strategies and parameters you select — until you revoke the key or disconnect the account.

You can revoke the key at your exchange at any time. Revocation takes effect immediately and ends our ability to act on that account. Note that revoking a key does not close any position that is already open; positions remain your responsibility and must be managed at the exchange.

You are responsible for the security of your exchange account, including its password and two-factor authentication.


6. Automated trading

When you follow a strategy, you instruct us to place orders in your account according to that strategy's rules and the parameters you set — such as allocation, leverage, stop-loss, and take-profit.

You acknowledge and accept that:

  • orders are placed automatically, without asking you first. That is the purpose of the Service;
  • strategies operate continuously and may trade at any hour;
  • execution depends on the exchange. Delays, partial fills, rejected orders, slippage, price gaps, downtime, and API failures at the exchange are outside our control, and can cause outcomes that differ from what a strategy would produce in ideal conditions;
  • the parameters you choose are your decision. Higher leverage and wider stop-losses increase the risk of liquidation;
  • a strategy may be paused, changed, or withdrawn, and we may stop offering it.

You remain responsible for monitoring your account. You should not assume that an automated system removes the need to pay attention.


7. Statistics and strategy information

Where we show statistics — such as return, win rate, maximum drawdown, Sharpe ratio, or uptime — we show them with their source and the basis on which they were calculated. Some figures are drawn from live trading; others may be examples or simulations, and are labelled as such.

These figures describe the past. They are not a forecast, a promise, or a recommendation. We do not rank, rate, endorse, or recommend any strategy, and the order in which strategies appear is not a judgement of their merit.

Statistics may contain errors, may be delayed, and may be revised. Your own results will differ, because they depend on when you started, how much you allocated, your parameters, and market conditions during your holding period.


8. Fees and how we are funded

Use of the Service is currently free of charge. We may introduce fees in the future; if we do, we will give you notice before they apply to you, and you will be free to stop using the Service.

The exchange charges its own fees — trading fees, funding fees, and others. Those are set by the exchange, are payable by you, and are not affected by this section.

Disclosure. To use the Service, your exchange account must be registered under ONYX's referral arrangement with that exchange, and ONYX may receive compensation from the exchange in connection with activity on accounts registered this way. This is how a free service is funded. It does not change the fees you pay the exchange, and it does not affect which strategies we show you or the order in which we show them.


9. Acceptable use

You must not:

  • use the Service unlawfully, or for market manipulation, wash trading, or any manipulative or deceptive practice;
  • access the Service through automated means other than as we provide, or attempt to scrape, reverse-engineer, decompile, or extract source code;
  • interfere with or overload our systems, or attempt to gain unauthorised access to any part of them;
  • connect an exchange account that does not belong to you, or provide credentials you are not authorised to use;
  • resell, sublicense, or commercially redistribute the Service or its data;
  • impersonate ONYX or misrepresent your relationship with us.

10. Availability

We aim to keep the Service running, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable because of maintenance, technical failure, or events beyond our control, including exchange outages.

We may modify, suspend, or discontinue any part of the Service. Where a change is material and we can reasonably give notice, we will.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.


11. Third parties

The Service depends on third parties, including exchanges and infrastructure providers. Your relationship with your exchange is directly with that exchange, governed by its terms. We are not responsible for their acts, omissions, fees, outages, insolvency, or policy changes, and we do not control them.

Links to third-party sites are provided for convenience and are not endorsements.


12. Intellectual property

The Service, including its software, design, text, and branding, belongs to us or our licensors and is protected by intellectual property law. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose. All rights not expressly granted are reserved.


13. Limitation of liability

To the fullest extent permitted by law:

  • we are not liable for trading losses, including losses caused by liquidation, market movement, leverage, slippage, or strategy performance;
  • we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost opportunity, or loss of data;
  • we are not liable for failures, delays, outages, errors, or insolvency at any exchange or third-party provider;
  • our total aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of the total fees you paid us in the twelve months before the claim arose, or USD 100.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, or for death or personal injury caused by negligence.


14. Indemnity

You agree to indemnify and hold harmless ONYX, its officers, employees, and agents against any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your violation of any law, or your infringement of anyone's rights.


15. Suspension and termination

You may stop at any time by unfollowing your strategies, revoking your API key at the exchange, and closing your account. Closing your account does not close open positions — you must manage those at the exchange.

We may suspend or terminate your access if you breach these Terms, if we are required to by law, if we suspect fraud or a security risk, or if we discontinue the Service. Where circumstances allow, we will give notice.

Sections that by their nature should survive termination — including Sections 2, 7, 12, 13, 14, and 17 — survive.


16. Changes to these Terms

We may update these Terms. If a change is material, we will notify you before it takes effect, by email or by a notice on the site. Continuing to use the Service after a change takes effect means you accept the revised Terms. If you do not accept them, stop using the Service and close your account.


17. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which ONYX's operating entity is established, and disputes arising out of or relating to them will be brought before the competent courts of that jurisdiction. We will state that jurisdiction by name in this section, and give notice of the change, once registration of the operating entity is complete.

Nothing in this section removes any mandatory protection available to you under the law of the country where you live, where that law applies to you and cannot be excluded by agreement.


18. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.

Severability. If any provision is unenforceable, the rest remains in effect.

No waiver. If we do not enforce a provision, that is not a waiver of it.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

Language. These Terms are written in English. If we provide a translation and the versions conflict, the English version governs.
